Monopolka Online Store Terms and Conditions

I. General Provisions

  1. These terms and conditions define the rules for using the online store Monopolka, available at www.monopolka.eu, by the consumer. It should be noted that these sales regulations do not exclude or limit the consumer's rights resulting from mandatory legal provisions that cannot be changed or waived by contract.

  2. The store is operated by Monopolka Małgorzata Szewczyk, based in Gdańsk, 80-126, Cedrowa 27/91, NIP 7393763737, Regon 221789947, email: monopolkadesign@gmail.com, phone contact: +48 691117737.

  3. The store is intended for individuals with full legal capacity and business entities. The parties to the sales agreement concluded via the online store www.monopolka.eu are the customer placing the order and the company Monopolka Małgorzata Szewczyk.

  4. The place of delivery for goods purchased through the online store www.monopolka.eu is within the territory of Poland.

  5. To use the online store properly, the user should have a computer and software meeting the following minimum requirements: an up-to-date browser (e.g., Internet Explorer, Firefox, Chrome, Opera, or any other available), a monitor with a resolution of at least 1024x768, cookies enabled, and the latest version of JavaScript. Adobe Acrobat Reader should be installed, as well as access to the internet and an active email account. It is also important to note that the appearance of products is affected by monitor size and settings. We do not accept complaints related to differences in color or design of items caused by improper monitor settings.

  6. Orders placed by customers will be processed if the product is available in Monopolka's warehouse. If the product is unavailable, Monopolka will provide this information on the product page of the website or in the product description. If no such information is provided, the product may still be unavailable, and the customer will be notified by email if the order cannot be fulfilled.

  7. A sales agreement for the products offered via the online store www.monopolka.eu is concluded when Monopolka accepts the customer’s order.

  8. The store uses cookies to store information necessary for functionality, such as saving browsing preferences. The user can decide which cookies to store and how, via their browser settings. By default, browsers allow cookies to be stored.

  9. The customer making purchases and logging into the store is required to provide data that is accurate and truthful, under penalty of not having their order fulfilled.

II. Products

  1. The online store www.monopolka.eu provides information about the essential properties of products, including their prices, which are listed on the product page (product card).

  2. Limited quantities of products are available for sale, including promotions and clearance items. Orders are processed in the order they are confirmed, until stocks are depleted.

  3. If a product is out of stock, Monopolka will display this information on the website. If Monopolka fails to provide such a notice and cannot fulfill the order, the company is entitled to cancel the sales agreement within 30 days from the conclusion of the contract. If the customer has paid for the product, Monopolka will refund the payment promptly, but no later than 14 days after the cancellation.

  4. All product prices listed on the online store are in Polish Zlotys (PLN) and include VAT. The price indicated on the product at the time of the order is binding.

  5. Monopolka reserves the right to change prices, add new products, and conduct promotions or sales at any time. These changes do not affect orders placed before the price change.

  6. All products offered by the online store are brand new, free from defects, and legally introduced to the Polish market.

III. Conclusion of Agreement (Order)

  1. Orders can be placed through the online store www.monopolka.eu 24/7, all year round.

  2. Orders will be processed on business days, from Monday to Friday, between 8 AM and 4 PM. Orders placed on non-business days will be processed on the next business day, in the order they were received.

  3. Every order includes a fiscal receipt or, upon request, a VAT invoice.

  4. Orders are accepted through the online store’s website, where customers:

    • Choose the products they want to order
    • Provide the delivery address and payment method
    • Confirm the order
    • Complete payment for the order.
  5. Before submitting the order, the customer can review and modify the data provided.

  6. By placing an order, the customer makes a binding offer to purchase the selected products. The customer agrees to the terms and conditions of the online store by completing the order process.

  7. The sales agreement is concluded once Monopolka accepts the customer’s order, making the contract legally binding.

  8. The customer may cancel an order that has not been shipped. To do so, the customer should contact the store as soon as possible by phone (+48 691117737) or email (monopolkadesign@gmail.com).

IV. Confirmation of Agreement

  1. Customer data provided during the order process is stored and processed by Monopolka in accordance with the Personal Data Protection Act (Journal of Laws 1997, No. 133, item 883, as amended). The customer has the right to access and correct their data, or request its deletion. Providing personal data is voluntary, but consent for its processing is necessary for order fulfillment. The customer is responsible for providing accurate data.

  2. The online store will send the customer a confirmation of the sales agreement in a reasonable time after the contract is concluded, no later than when the product is delivered. The confirmation will include all relevant details from the order.

According to Article 535 §1 of the Civil Code, the buyer is obliged to collect the item and pay the seller the agreed price. Therefore, if the buyer refuses to accept a COD delivery, they are in breach of contract.

According to Article 471 of the Civil Code, "The debtor is obliged to repair the damage caused by non-performance or improper performance of the obligation, unless the non-performance or improper performance is due to circumstances for which the debtor is not responsible." This means that the buyer who refuses to accept a COD shipment should repair all the damage incurred by the seller due to the shipment and the return of the unclaimed item.

V. Delivery Terms

  1. Monopolka undertakes to deliver the ordered goods within 30 days from the date of accepting the order or receiving payment for the product (if payment is made in advance). However, the usual delivery time is between 3 to 8 business days from the order date or payment receipt.

  2. Deliveries are made via the Polish Post or courier companies to the address provided by the customer in the order, or to a pickup point selected by the customer. Monopolka is not responsible for non-delivery or delays caused by incorrect or incomplete addresses provided by the customer.

VI. Shipping Costs

  1. Shipping costs for orders made through the online store depend on the chosen delivery method and payment option. The current shipping fees can be found on the store’s website under "Shipping Costs and Options."

  2. The customer pays part of the actual cost of packaging and shipping the product, with the remainder covered by Monopolka.

  3. In cases where delivery occurs in multiple stages, the customer will only pay for shipping once.

VII. Reservation of Ownership

  1. The product remains the property of Monopolka until the customer has paid the full amount for the order.

VIII. Payment Terms

  1. The customer may choose one of the following payment methods for the order:
    • Cash on delivery (COD) or payment by card upon delivery
    • Bank transfer to Monopolka’s account
    • Online payment via Przelewy24
    • Online payment via PayPal
    • Online payment via BLIK

Payments made by card or e-transfer are processed through Przelewy24, which accepts Visa, Visa Electron, Maestro, MasterCard, and MasterCard Electronic cards.

  1. Monopolka excludes the possibility of payment via money transfer or cheque. The company is not responsible for the loss of funds sent in these ways.

  2. Depending on the chosen payment method:

    • For COD, payment is made upon delivery.
    • For bank transfers, payment is required in advance. The order will be shipped after payment is received, with a 7-day deadline for payment. After 7 days, the order will be canceled.
    • For online payments via Przelewy24, payment is required in advance, and the order will be shipped once payment is received. After 7 days, the order will be canceled.

IX. Right to Withdraw from the Agreement

  1. The customer has the right to withdraw from the sales agreement (i.e., return the product without giving a reason) within 14 days of receiving the product or the last part of a multi-item order.

  2. To exercise the right to withdraw from the agreement, the customer must submit a written declaration within the specified 14-day period. The declaration should be sent to: Monopolka Małgorzata Szewczyk, Cedrowa 27/91, 80-126 Gdańsk, with the note "Withdrawal from Agreement," or by email at monopolkadesign@gmail.com.

    X. Complaints and Warranty Liability

    1. Monopolka Małgorzata Szewczyk is obligated to sell and deliver goods that are free from physical and legal defects.

    2. The customer has the right to submit a complaint in case the goods have a physical or legal defect (warranty).

    3. A physical defect is defined as a discrepancy between the goods and the sales agreement. Specifically, the goods are considered to be inconsistent with the sales agreement if:

      • The goods do not have the properties they should have due to their purpose specified in the sales agreement or resulting from circumstances or destination;
      • The goods do not have properties that Monopolka Małgorzata Szewczyk assured the customer of;
      • The goods were delivered incomplete.
    4. Monopolka Małgorzata Szewczyk is liable for physical defects that existed at the time the goods were handed over to the customer or resulted from a defect inherent in the goods at the time of delivery.

    5. A product has a legal defect if it is the property of a third party or is encumbered with the rights of a third party, or if the use or disposal of the product is restricted due to a decision or ruling by a competent authority.

    6. Customers should send any complaints via email to monopolkadesign@gmail.com, or by post to: Monopolka Małgorzata Szewczyk, Cedrowa 27/91, 80-126 Gdańsk, with the note "Complaint."

    7. If the product is defective, the customer is entitled to:

      • Request the defective product be replaced with one free from defects, or request the defect be removed.
      • Submit a declaration for a proportional reduction in the price or withdrawal from the agreement, provided that Monopolka Małgorzata Szewczyk can immediately and without undue inconvenience to the customer replace the defective product or remove the defect. However, if the product has already been replaced or repaired by Monopolka Małgorzata Szewczyk, or if the company has failed to replace the product or remove the defect, the customer may make a declaration for a proportional reduction in price or withdrawal from the agreement.
    8. The customer may not withdraw from the sales agreement if the defect is insignificant.

    9. The customer may request the replacement of the product with a defect-free one, or the removal of the defect, as an alternative to the solution proposed by Monopolka Małgorzata Szewczyk, unless bringing the goods into compliance with the sales agreement using the customer's chosen method is impossible or would require excessive costs compared to the method proposed by Monopolka Małgorzata Szewczyk.

    10. Monopolka Małgorzata Szewczyk may refuse to replace the defective goods with defect-free goods or to remove the defect if bringing the goods into compliance with the sales agreement in the manner chosen by the customer is impossible or would require excessive costs compared to the other possible method.

    11. Complaints will be processed no later than 14 days from the date of receiving the complaint by Monopolka Małgorzata Szewczyk, and the customer will be notified by email, SMS, or postal mail at the address provided by the customer.

    XI. Final Provisions

    1. For matters not regulated on the website of the store www.monopolka.eu, Polish law applies, in particular, the Consumer Rights Act and the provisions of the Civil Code.

    2. The products presented on the website of the store www.monopolka.eu do not constitute an offer within the meaning of the Civil Code.

    3. Monopolka Małgorzata Szewczyk reserves the right to change the terms of sale conducted via the www.monopolka.eu website. Any changes will be effective from the date of publication on the website www.monopolka.eu. Orders placed before the date of changes to the sales terms will be fulfilled based on the terms in effect at the time the order was placed.

    4. Any disputes between the customer and Monopolka Małgorzata Szewczyk will be resolved by common courts in Poland, although the customer also has the option to use alternative dispute resolution methods. Specifically, the customer may opt for mediation or referral to an arbitration court. To do so, the customer should submit the appropriate form to the institution handling the dispute. Consumers may also submit their complaints via the EU's Online Dispute Resolution platform (ODR), available at: [Online Dispute Resolution].

    5. To maintain the User's account and conclude and execute sales agreements, as well as to fulfill the obligations arising from remote sales agreements, Monopolka Małgorzata Szewczyk processes the personal data of the customer, which the customer provides voluntarily.     6. These Terms and Conditions are effective as of July 1, 2024.
